Professor
Enrich headed to Supreme Court
The Supreme Court announced that it will hear arguments this winter in
the case of DaimlerChrysler Corp. v. Cuno, reviewing the Sixth
Circuit’s decision (386 F.3d 738 (2004)) holding that Ohio’s
investment tax credit program violates the dormant Commerce Clause by
offering tax subsidies that discriminatorily favor those businesses that
choose to locate new economic activity in the state. As lead counsel,
Professor Enrich will brief the case with the support of more than a dozen
NUSL student research assistants and he will argue before the court in
early 2006. If the Sixth Circuit decision is upheld, Enrich stated that
it “will sharply curtail the current proliferation of state and
local corporate tax breaks, which are resulting in a costly and unproductive
race to the bottom in state corporate taxation.”
